GDPR-Style Fines under the Proposed Consumer Privacy Protection Act in Canada: Advice from Across the Pond on the GDPR Experience

The federal Minister of Innovation, Science and Industry last fall introduced Bill C-11 “An Act to enact the Consumer Privacy Protection Act and the Personal Information and Data Protection Tribunal Act and to make consequential and related amendments to other Acts” (the “Act”).  In addition to the new right of data portability and the right to be forgotten, the Act has taken the lead from the EU General Data Protection Regulation (the “GDPR) in introducing financially enormous penalties. In this two-part session, John Beardwood (Fasken LLP; ITechLaw Past President) will first review the proposed penalty scheme under the Act, followed by German guest speaker Kai Westerwelle (Bird & Bird LLP) who will then draw upon his extensive knowledge and experience of 2+ years of GDPR in order to review the factors contributing to the application of these fines in EU, evaluate trends regarding these fines, and provide tips for the avoidance of fines under the Act based on the EU experience.  This unique and timely session is not to be missed.
