AI Evolution: Recent Advances in Copyright and Generative AI Webinar image

This webinar will discuss the recent legal developments concerning Generative AI. The panel will discuss the current state of the law concerning the right of AI developers to use content to train AI models, and whether such use requires a license or is considered a Fair Use under copyright principles. This will include a review of some of the recently filed cases considering those issues, including suits by the Author’s Guild against Open AI and the lawsuit by the New York Times against Open AI and Microsoft and similar cases in the EU.  The current state of the availability of copyright protection for AI generated content will be covered. The panel will also address some of the recent business developments concerning the use of AI in both the gaming industry and in other entertainment contexts.

About The Speakers

Ira Schwartz, Parker Schwartz, United States, Moderator 

Ira M. Schwartz is a partner in the firm with a practice emphasizing intellectual property law, including copyright, trademark, trade secret, computer and Internet law, and intellectual property litigation. His practice further includes domain name disputes, counseling clients on social media issues, blogging issues, and the related areas of business defamation, unfair competition, drafting and enforcement of confidentiality agreements and restrictive covenants, and rights of privacy and publicity. He has also represented many international clients in their intellectual property matters. Mr. Schwartz also actively serves as a mediator and arbitrator of intellectual property disputes. In addition, he counsels both existing enterprises and startups on all aspects of commercializing new creative and technological products. He is a past President of the State Bar of Arizona Intellectual Property Section and a member the State Bar of Arizona Business Law Section. Mr. Schwartz serves on the Board of Directors of the International Technology Law Association. He is a also a member of the Intellectual Property Section and the Alternative Dispute Resolution of the American Bar Association and a member of the American Intellectual Property Lawyers Association.

M. Georgia Gibson Henlin, KC, Henlin Gibson Henlin, Jamaica 

Georgia is one of the founding partners and the Managing Partner. She is a King’s Counsel at the Jamaican bar and a national honouree. She is also a member of the bars of Ontario, New York, and the British Virgin Islands with availability in the Cayman Islands, as necessary. Georgia is a sought after litigator. She has been ranked in Band 1 of Chambers Global Guide since 2023 where she is described as “one of the most capable litigators in the Caribbean Region.” She has been ranked for seven years. She is a multifaceted and talented legal practitioner. Her practice covers information technology, telecommunications & broadcasting, competition law, oil and gas, commercial and complex legal issues. Other areas of her experience include intellectual property, commercial transactions, software licensing, finance and taxation. In 2002, she was awarded a Master of Laws Degree in Innovation Law & Policy from the University of Toronto where she specialised in eCommerce & Information Technology, Legal Issues in Cyberspace, Telecommunications Economics, Wireless Communications (Spread Spectrum), Internet Law and Governance, Entertainment Law, Freedom of Expression and the Press, Intellectual Property in the Digital Era and Intellectual Property in Cyberspace. Her past clients include the regulatory authority for broadcasting and telecommunications.

Adam Gertz, Morrison Cooper, United States 

Throughout Adam’s career, he has been a tireless advocate for player and creator rights and has negotiated hundreds of player and content creator agreements with top tier esports orgs along with countless brands, agencies, and production companies. In addition to his work in esports, Adam also oversees much of Morrison Cooper’s video game and entertainment practice and has successfully represented numerous game publishers and developers in all manner of transactions including game publishing, employment and contractor matters, IP and merchandise licensing, and, when necessary, disputes. As to the latter, Adam has brokered settlements for numerous clients, without the need to resort to costly, uncertain, and time consuming litigation. In his free time, when he’s not playing the latest open world masterpiece or being carried in an FPS by his friends and colleagues, Adam enjoys spending time with his wife, his two daughters, and their dog Cora.

Ricardo Gómez-Barreda, CMS, Spain 

Ricardo Gómez-Barreda is an Associate of the Industrial / Intellectual Property & Digital Business department at CMS Albiñana & Suárez de Lezo. He specialises in intellectual and industrial property, trade secrets, unfair competition and digital business. Moreover, his practice spans both contentious and non-contentious issues in relation to copyright, trademarks, designs, patents, utility models, unfair competition, advertising, image rights and privacy. Regarding contentious matters, Ricardo provides advice on disputes before the various industrial property registration authorities (SPTO, EUIPO and WIPO). What’s more, he also advises on matters relating to IT, e-commerce and personal data protection.
