Dr. Urs Gasser, Berkman Klein Center for Internet & Society

Harvard University

Dr. Urs Gasser is the Executive Director of the Berkman Klein Center for Internet & Society at Harvard University and a Professor of Practice at Harvard Law School. His research and teaching activities focus on information law, policy, and society issues and the changing role of academia in the digitally networked age. At Berkman Klein and in collaboration with the MIT Media Lab, he co-leads the Ethics and Governance of Artificial Intelligence Initiative, with a particular interest in global governance issues and the broader implications of next-generation technologies, including questions of human autonomy and inclusion. As a long-term research interest, he studies the patterns of interaction between law and innovation, and innovation with the legal system in the digital age.

During this dynamic session, several of the co-authors of our newly published AI Whitepaper will each present salient and actionable features of the fundamental principles of ethical artificial intelligence design, development and implementation.  The panel will explore concrete challenges and solutions to the implementation of such core essential principles as “accountability”, “open data and fair competition”, “transparency and explainability”, as well as “fairness and non-discrimination.”

Medical technology, diagnostics and treatment, are becoming increasingly personalized or individualized. “Precision medicine” is the term
used to describe the revolution in biotechnology in which precision is used to identify not only a disease condition and general treatment but
also a specific abnormality or predisposition and a narrowly tailored treatment for the specific abnormality based on an individual’s biological
makeup, genes, and/or condition. Since precision medicine is specific to an individual, diagnostic and treatment of a condition depends on that
individual and the specific treatment. We will explore the world of precision medicine and discuss whether current intellectual property rights
are a benefit or a hindrance to the development and deployment of precision medicine.

As AI technologies proliferate, there is little doubt that these technologies and their applications are preceding specific regulation. Cybersecurity is one of the key risks for corporations all around the world in 2019. This session will discuss the various risks involved and how to manage them, prebreach and post breach. The panellists will discuss board member liability and decisions, including the yahoo settlement, and details of what corporations need to do to prevent a breach and manage the resulting litigation. Additionally, the session will cover the main regulatory requirements worldwide, including data mapping, assessment of information systems, and what should be included in an incidence response plan to respond to a breach. The session will conclude with a discussion of cyber insurance and the related uncertainly following the denial of a claim that resulted from the global NotPetya ransomware attack.

It has been a year since GDPR went into affect. Was it the start of a data protection revolution or a data protection catastrophe? How have data and security practices changed, and what have we learned? How are data protection laws are changing around the globe. After 6-years of negotiations, Brazil has enacted its General Data Protection Law (GDPL), set to take effect in February of 2020. California, the most populous state in the United States, passed the California Consumer Privacy Act (CCPA), which is similarly set to take effect on January 1, 2020. And finally, Russia is in the midst of yet another set of new data protection rules. Join us as we learn about how each of these laws will affect our clients, how to comply, and how to survive.
