Professor Paal has more than 25 years of experience in academia. He is the editor and author of leading commentaries and publications on all areas of the law and regulation of the digital transformation. As an accomplished legal scholar, he is responsible for more than 200 publications, including leading books on Information, Media, and Data (Protection) Law. Professor Paal provides legal expertise in various settings to public and private institutions; inter alia, he is a member of several advisory boards and serves as an expert to the EU Commission and the German Parliament.

When platforms make the differences in elections: Platform regulation vs. free speech and the influence of hostile states

On the panel, we will discuss and shed more light on the different approaches of global platform regulation (especially in the EU and the U.S.), the cooperation of providers with supervisory authorities as well as own initiatives of platforms. In this context, we will examine the challenges that bots, fake news and interferences by foreign states pose (especially relating to elections, such as the upcoming U.S. elections) and how providers deal with them and at the same time consider fundamental rights (such as the freedom of speech), including the relevant regulatory frameworks and court proceedings in the EU and the U.S.

With insights from distinguished speakers notably from within the cybersecurity industry, this session will offer a comprehensive analysis of current trends and future directions in global cybersecurity regulation.

 

6B: IP & AI | Unlocking AI's Potential: Balancing IP, Trade Secrets, and Innovation

This panel will tackle the complex relationship between intellectual property law and generative AI, highlighting the legal, technical and business challenges associated with training AI models, data mining, web scraping, and the use of generative AI in various business applications, such as… TBD. As generative AI technology advances, pressing questions arise regarding intellectual property rights, particularly the opposing interests of intellectual property owners and AI model developers. We will explore the balance between transparency obligations for general-purpose AI model providers introduced by Article 53 of the EU AI Act and the protection of trade secrets and confidential business information. Additionally, we will discuss the boundaries of legitimate use of text and data mining for training general-purpose, as well as potential open-source obligations for outputs of general-purpose AI systems, considering the exemption for open-source models in Article 53 of the EU AI Act. This discussion aims to address these issues from multiple angles, including legal, technological, and creative viewpoints, and from the perspective of various jurisdictions. Furthermore, real-world case studies and technical methodologies for data mining and web scraping will be illustrated.

7A | FinTech Dora Technology Sourcing

For many years Andrea Görres has been working as General Counsel for Wirecard, a Munich based FinTech company offering payment systems, e.g. for online transactions. It was involved in one of Germany’s largest financial scandals after World War II, when it turned out in 2020 that 1.9 billion Euro in offshore bank accounts which the company had reported in its financial statements did in fact not exist. The CEO is still in jail and criminal proceedings against him and two other key managers are still ongoing. One of the key managers fled Germany just in time and is probably in Russia.

Tom Braegelmann is an internationally experienced insolvency and restructuring expert, admitted to the bar in both Germany and the USA. For more than three years, he practiced bankruptcy law/insolvency and copyright law in New York City. Tom Braegelmann is very familiar with the latest technological legal developments, in particular with the digitalization of business, restructuring and insolvency law. In addition, another further focus of his advice are modern digital business models.
