Virtual Worlds and Online Gaming Working Group

ITechLaw is pleased to announce the formation of a new working group focused on virtual worlds and online games. This group will address various legal issues relating to virtual worlds and social/online gaming (and perhaps related technologies such as mirror worlds and augmented reality) with a view to engaging in innovative studies that will lead to conference programming, association publications and policy proposals. 
 
The impetus for this working group is the continued rapid growth in virtual worlds, social gaming, virtual goods and virtual currencies, and the legal issues associated with them. Many of the legal issues fall within the general scope of the existing substantive committees (Data Protection, E-Commerce, IP and Outsourcing), but not exclusively in the purview of any one committee. And, some of the legal issues extend beyond the scope of any of these committees.
 
The working group will hold its initial meeting at the Boston conference and would like to invite all interested ITechLaw members to join the working group. This working group will be co-headed by Jim Gatto and Jenna Leavitt of Pillsbury. Marc FriedmanGoing Once, Going Twice: Second Circuit Affirms Counterfeit Sales on eBay Do Not Amount to Contributory Trademark Infringement

The Second Circuit affirmed that eBay cannot be held liable for trademark infringement due to the sale of counterfeit goods on its Web site, as long as the online auction leader takes steps to remove those items and is not willfully blind to their presence.  Tiffany (NJ) Inc., et al. v. eBay Inc., No. 08-3947-cv (2d Cir. April 1, 2010).  Tiffany's action against eBay asserted claims of trademark infringement, trademark dilution and false advertising arising out of eBay's advertising and listing practices, which include charging fees to sellers for listing items and completing sales, and promoting the availability of Tiffany items through advertising.  Id. at 3, 14.  Read more.

ITechLaw Member Cynthia Larose, of Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C.'s Corporate section, has been selected by Boston University Woman's Law Association as the co-recipient of this year's Leila Josephine Robinson Award. The award, named after the first female law school graduate in Massachusetts and first woman admitted to the Massachusetts bar, was presented on April 8 at a reception hosted by Mintz Levin.

A Member in the Boston office and Chair of the firm's Privacy and Information Management Practice, Ms. Larose represents companies in information, communications and technology, including e-commerce and other electronic transactions.

President's Column

Dear ITechLaw Members and Colleagues,
 
It has been a great honour to serve the association this past year as your President.
 
My presidential goals were to increase transparency, standardization of processes and financial stability, to implement new committees in order to enhance what we are offering and continue to grow even more, as well as continue to modernize the association.
 
Throughout the year, I have been delighted to run three very successful conferences in Brussels, Bangalore and Boston, as well as one Roundtable in Seattle. Our Global Sponsors have increased now to five sponsors. A new website and social networking platform has been installed. I encourage you all the put up your profiles on ITechLaw Connect, as well as network with ITechLaw members on other social media such as with the ITechLaw Group on LinkedIn.
 
I was also very happy to introduce new committees, such as the Membership Committee, to re-structure the Local Representatives Committee with the new rotation system, as well as to support the brand new Virtual Worlds and Gaming Working Group. This new working group is being Co-Chaired by James Gatto and Jenna Leavitt. They will have their first meeting in Boston on May 20, 2010 and I wish them an excellent start!
 
Therefore, I feel that my goals have been met and I hope in doing so I have been able to contribute to the growth of our association and enhance your experience as a member.
 
I would like to thank all of those who worked very actively for the association this past year and I hope you continue to do so.
I look forward to continuing to support the association, as I will serve - as Immediate Past President - for one more year on the Executive Committee, as well as continue to work on the IVAP Committee to enhance the Traveling Fellowship Award program and to co-chair the upcoming India Conference in Bangalore 2011.
 
I will hand the baton over to Sandy Jeskie in Boston at the end of the conference and I wish Sandy all the best for her presidency.
 
Do not forget that each of you will always be welcome in Switzerland to discuss issues of common interest in the fields of IT and Telecom law.
 
I look forward to seeing you in Boston!
