Letter from ITechLaw President Ursula Widmer
Members and Colleagues,
As a member of ITechLaw for many years, serving the
association on both the Board of Directors and Executive
Committee, I have watched ITechLaw develop from a mostly US
association into an international association now
representing 53 countries and five continents.
I am deeply honored to have been elected the new President
of ITechLaw, the world's leading association of legal
experts who concentrate on technology issues with a
particular emphasis on information technology and
I would like to welcome those who are similarly interested
as new members, to enjoy the excellent education,
publications and networking benefits that ITechLaw provides. Tell
us about your interests, get involved, speak at our conferences,
interact within our specialized committees and send us your
news and articles to be published in the quarterly eBulletin
and the monthly eNews.
I hope to see you at one of our
conferences this year in
Estonia and Brussels and in 2010 in Bangalore and Boston. I

This month CommitteeWatch puts the spotlight on
I-WIN, the ITechLaw Women's International Network:
enthusiastic leadership of Committee Chair and Board Member
Françoise Gilbert, I-WIN recently hosted a meeting at the
ITechLaw 2009 Annual Meeting and World Conference in
Seattle. Open to all conference attendees, the meeting
featured a presentation by Colleen Martin, Deputy General
Counsel at Washington Mutual Inc. Colleen led a discussion
on the relationship between lawyers who practice in
corporate legal departments and their use and expectations
of outside counsel. Look for a special article on this

In addition to
the Seattle meeting, I-WIN's recent activities include list
serv growth with frequent exchanges of expertise and
references, an overall increase in the
percentage of women in ITechLaw and affiliate membership in the

In a judgment of
May 6, 2009 the German Federal Supreme Court held that the
defendant in a patent infringement case may defend itself on
the basis that the patent owner misuses a market dominating
position by refusing the grant of a license. The so-called
compulsory license estoppel requires the defendant who uses
the patent without a license to show that
(i) he has made unsuccessful efforts to obtain a license on
(ii) by refusing the license the patent owner infringes the
prohibition under antitrust laws to discriminate other
enterprises or to prevent competition without objective
(iii) he has fulfilled the obligations under the desired
license, i.e., he has regularly rendered account on the use
of the patent and has paid or at least escrowed the
appropriate license fees.

ITechLaw's 2009 Annual Meeting and World Conference
recently took place in Seattle, May 14-15, 2009. Attendees from
jurisdictions around the world joined together to enjoy
