Letter from ITechLaw President Ursula Widmer

 

Dear ITechLaw Members and Colleagues,

As a member of ITechLaw for many years, serving the association on both the Board of Directors and Executive Committee, I have watched ITechLaw develop from a mostly US association into an international association now representing 53 countries and five continents.

I am deeply honored to have been elected the new President of ITechLaw, the world's leading association of legal experts who concentrate on technology issues with a particular emphasis on information technology and telecommunications.

I would like to welcome those who are similarly interested as new members, to enjoy the excellent education, publications and networking benefits that ITechLaw provides. Tell us about your interests, get involved, speak at our conferences, interact within our specialized committees and send us your news and articles to be published in the quarterly eBulletin and the monthly eNews.

I hope to see you at one of our conferences this year in Estonia and Brussels and in 2010 in Bangalore and Boston. I also look forward to meeting you at an upcoming President's lunch.

Under the enthusiastic leadership of Committee Chair and Board Member Françoise Gilbert, I-WIN recently hosted a meeting at the ITechLaw 2009 Annual Meeting and World Conference in Seattle. Open to all conference attendees, the meeting featured a presentation by Colleen Martin, Deputy General Counsel at Washington Mutual Inc. Colleen led a discussion on the relationship between lawyers who practice in corporate legal departments and their use and expectations of outside counsel. Look for a special article on this enriching  presentation in the upcoming June eNews.

In addition to the Seattle meeting, I-WIN's recent activities include list serv growth with frequent exchanges of expertise and references, an overall increase in the percentage of women in ITechLaw and affiliate membership in the National Association of Women Lawyers (NAWL). ITechLaw Receives Prestigious Awards

Last month we reported that the ITechLaw eNews garnered the top award of the Web Marketing Association's Internet Advertising Awards, winning for Best Legal Online Newsletter Campaign.

This month we are pleased to report that eNews also won two Hermes Gold Awards for:

  - Best eNewsletter, and
  - Best Design/Publication Overall

The I-WIN Committee also won a top award for Best Ad Copy for its 2009 marketing materials. 
 

Administered by the Association of Marketing and Communications Professionals, the Hermes Creative Awards is an international competition for creative professionals involved in the concept, writing and design of traditional

materials and programs, and emerging technologies.

Germany: New Supreme Court Case Law on the Compulsory License Estoppel in Patent Infringement Litigation

In a judgment of May 6, 2009 the German Federal Supreme Court held that the defendant in a patent infringement case may defend itself on the basis that the patent owner misuses a market dominating position by refusing the grant of a license. The so-called compulsory license estoppel requires the defendant who uses the patent without a license to show that

(i) he has made unsuccessful efforts to obtain a license on suitable conditions,

(ii) by refusing the license the patent owner infringes the prohibition under antitrust laws to discriminate other enterprises or to prevent competition without objective reason, and

(iii) he has fulfilled the obligations under the desired license, i.e., he has regularly rendered account on the use of the patent and has paid or at least escrowed the appropriate license fees.

ITechLaw's 2009 Annual Meeting and World Conference Draws International Crowd

ITechLaw's 2009 Annual Meeting and World Conference recently took place in Seattle, May 14-15, 2009. Attendees from jurisdictions around the world joined together to enjoy knowledge sharing and networking with fellow technology law professionals. The conference had more than 200 registrants representing 33 countries.

Speakers included in-house counsel from Microsoft, T-Mobile, Alcatel-Lucent, Vidiator and more. Sessions provided in-depth explorations of the latest trends and developments in the technology sector and the resulting legal implications.

On May 21st ITechLaw Board Member Felix Hofer presented at Seattle University School of Law, together with panelists from Australia, Canada and the US, on the topic of Green Marketing. His specific task was to address the European approach to the topic. His presentation was based on his article recently published in Volume 3, issue 2 of the eBulletin.

ITechLaw Vice President Sandra Jeskie was recently appointed to serve as special master to two different courts in a multi-district litigation and complex commercial case. She was also an invited speaker at the Third Circuit Judicial Conference on May 5-6, 2009 where she spoke with a panel of judges on the topic of Technology in the Court Room.
